This Privacy Notice describes how Augmedics, Inc. and its affiliates and subsidiaries (collectively, “Augmedics”) collect, use, share, and protect personal information gathered through the Augmedics’ owned internet website (the “Site”) or other information gathering platforms Augmedics may use (collectively “Services”) that link to this Privacy Notice, as well as through your offline interactions with you.

AUGMEDICS’ USE OF PERSONAL INFORMATION

Data Collected  

We can collect identifying data, such as for instance name, surname, email address, residence, and any other information that you voluntarily provide by communicating with us, such as by sending an email or submitting an online information request form.  Additionally, we can collect any other personal information that you choose to provide to us through our Services. This includes information you provide to us (or our service provider) to apply for a job. Other information provided through a job application may include, for example, your educational and employment background, your contact information, and immigration status.

How Data is Used

If you do voluntarily provide personal data through our Site or Services, we may use this information to provide you the business service or to respond to your requests (including to consider you for employment). Furthermore, we may send you communications to provide other information that we think may be of interest to you. We may also process personal data in order to fulfil legal obligations relevant to us. 

Augmedics does not sell personal data for monetary or other valuable consideration. We also do not share personal information for behavioral advertising purposes, including cross-context behavioral advertising. We do not use sensitive personal information for inferring characteristics about individuals. Augmedics does not use automated processing of personal information for profiling purposes.

However, we may provide your personal information to our affiliates and subsidiaries and our partner entities that are not within our corporate family.  We may transfer your personal information to a successor entity if we go through a business transition such as a merger, acquisition by another company, bankruptcy, reorganization, or sale of all or a portion of Augmedics’ assets.

Law Enforcement

Under certain circumstances, we may release any information, including personal information, in response to court and governmental orders, civil subpoenas, or discovery requests where permitted by applicable local law, and as otherwise required by law.  

Cookies and Analytics

Cookies are text files stored on our Site’s servers and your web browser and are used by the Site to remember you for various purposes. To learn more about the cookies used on our Site, or to change or withdraw your consent for certain cookies at any time, please click the Cookie Settings link in the cookie notice banner or in the footer of the Site.

Like most other websites and services, Augmedics uses cookies to help keep our Site stable, secure, and provide a user experience free of interruption. These cookies are essential to the proper functioning of our Site and Services.  We may also use service providers, such as Google Analytics that may use cookies to collect information about your online activities across this and other sites over time for non-advertising purposes, such as those described above. We use this aggregated data analysis to gain insights on user activity and improve the content and functionality of the website.

Marketing Communications

In jurisdictions that require prior consent for marketing communications, we may send you promotional e-mails if you have consented to receiving such communication. At any time, you may revoke your consent for the receipt of communications that Augmedics sends to you by following the unsubscribe process or contacting us at customerservice@augmedics.com. Please follow the instructions in our emails to unsubscribe from receiving future marketing communications from us.  Please note that even if you unsubscribe from newsletters and promotional emails, we may still need to contact you for non-marketing purposes.

Job applicants

If you apply for a job with Augmedics, we will use the personal information that you provide in your application, including any attachments sent, for the purpose of considering your candidacy for employment. This data includes your name and contact information, the information in your resume or CV, your job preferences, and your profile. If you have a social media profile, including a LinkedIn profile, Augmedics may process the data you choose to share on social media as well. 

If you use our online job board hosted by Comeet, your personal information will also be processed according to Comeet’s privacy notice, found here: https://help.comeet.co/en/articles/5968370-privacy-policy.  

Links to Third Party Sites

The Site

The Site may provide links to other web sites or resources over which Augmedics does not have control (“External Web Sites”). Such links do not constitute an endorsement by Augmedics of those External Web Sites. You acknowledge that Augmedics is providing these links to you only as a convenience, and further agree that Augmedics is not responsible for the content of such External Web Sites. Your use of External Web Sites is subject to the terms of use and privacy policies located on those External Web Sites. We encourage you to read the privacy policy of any web site that you visit before you provide any information to the operator of that web site.

 

LEGAL BASIS FOR PROCESSING

Augmedics will only process (i.e. use) your personal data when the law allows us to, that is, when we have a legal basis for processing.  We use your personal data in the following circumstances:

  • Performance of a contract: where we need to perform a contract with you as a party or to take steps at your request before entering such a contract;
  • Legal or regulatory obligation: where we need to comply with a legal or regulatory obligation that we are subject to;
  • Legitimate interests: where necessary for our interests (or those of a third party), provided that your fundamental rights do not override such interests. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests;
  • Consent: where you have provided your consent to processing your personal data; and
  • Public interest: where the processing is necessary to protect the life or imminent safety of you or another individual, where no other legal basis applies.

Augmedics does not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law).

We only rely on consent as the legal basis for processing your personal data where it is required by applicable local law (for instance, in relation to some of our electronic marketing). You have the right to withdraw your consent at any time. When you withdraw your consent, we will stop the data processing.

 

RETENTION, LIMITATIONS ON USE & DATA INTEGRITY

Augmedics will keep your personal data for as long as is reasonably necessary or required by law for the purpose of the processing.  We retain personal information until it is no longer necessary for providing our products and services, fulfilling our contractual agreements with you, complying with applicable law, protecting Augmedics’ rights and interests (e.g., where the retention is necessary for the establishment, exercise, or defense of legal claims), or otherwise needed for the purposes for which it was collected or processed.

Augmedics will only process personal information in a way that is compatible with and relevant to the purpose for which it was collected or authorized for by the individual. Augmedics will take reasonable steps to ensure that personal information is accurate, complete, current, secure, and reliable for its intended use.  We employ procedural and technological security measures that are designed to protect your personally identifiable information from loss, unauthorized access, disclosure, alteration, or destruction.  However, please remember that no method of transmission over the internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. 

 

YOUR PRIVACY RIGHTS

Augmedics respects your rights concerning your personal information. Accordingly, you have the right, subject to necessary validation of your identity, to:

  • request confirmation whether your personal information is being processed;
  • request access, know, or receive a copy of your personal information we collected about you;
  • request correction of inaccurate, incomplete, or out-of-date personal information relating to you;
  • request information about the entities with which Augmedics has shared your personal information;
  • object to Augmedics’ processing of your personal data for direct marketing;
  • oppose processing based on our legitimate interest for reasons relating to your particular situation, unless we provide compelling legitimate grounds for the processing which override your privacy interests;
  • request (under certain circumstances) the restriction of the processing of your personal data;
  • request the anonymization or deletion of your personal information, subject to certain restrictions (described below)
  • lodge a complaint with a Data Protection Authority if you have concerns about our practices regarding the processing of personal data.

Exercising Your Rights and Validating Your Identity

You may, without charge, request to review, know, correct, update, delete, or restrict or object to the processing of your personal information at any time by emailing us at privacy@augmedics.com.  

To protect you and your personal information, requests must provide sufficient information for us to reasonably verify you are the person or an authorized representative of the person whose personal information is the subject of the request and describe your request with sufficient detail for us to properly understand, evaluate, and respond to it.

Exceptions to Deletion Requests

If you request the deletion of your personal information, depending on the nature of the data, deletion may consist of erasing, aggregating, or anonymizing your information. After we receive and validate your request, we will delete and direct our service providers to delete your personal information, unless an exception applies. We may deny your deletion request, in whole or in part, if retaining the information is necessary for us or our service providers to:

  • complete the transaction for which we collected the personal information, provide a service that your requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract with you;
  • detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities,
  • debug to identify and repair errors that impair existing intended functionality,
  • enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us or make other internal and lawful uses of that information that are compatible with the context in which you provide it, or
  • comply with a legal obligation, including maintaining a record of your request and our response.

 

INTERNATIONAL DATA TRANSFERS

If you are visiting our Site from locations outside of the United States, please note that any information you provide to us through your use of the Site may be transferred to and processed in countries other than the country from which you accessed this Site, including the United States where our computer systems are currently based. 

Augmedics will take all steps reasonably necessary to ensure that information provided is treated securely and in accordance with this Privacy Notice.

 

CHILDREN’S PRIVACY

This Site is not intended for children under the age of 18. Augmedics does not target its products or services or this Site to children under 18. Augmedics does not knowingly collect personal information from children under the age of 18. If Augmedics becomes aware that we are unconsciously collecting such information, Augmedics will promptly delete and/or destroy it.

 

PRIVACY NOTICE UPDATES

Augmedics may need to update this Privacy Notice on occasion. If we update this Privacy Notice, we will post the updated Privacy Notice on our Site and update the effective date at the top of the notice. We encourage you to regularly visit this Privacy Notice to ensure that you are aware of our current practices with respect to any information that you provide to us through the Site.
